END-USER LICENSE AGREEMENT (EULA)

IMPORTANT – READ CAREFULLY: This End-User License Agreement ("EULA") is a legal agreement between you and Funky Duke Ltd. ("Company") for the use of the Company’s game software, including any updates, upgrades, and accompanying materials ("Software").

By installing, accessing, or using the Software, you acknowledge that you have read and understood this EULA and agree to be bound by its terms. If you do not agree, do not install or use the Software.

1. COPYRIGHT
The Software and all related content are protected by copyright and intellectual property laws. All rights not expressly granted to you under this EULA are reserved by the Company or its licensors.

2. GRANT OF LICENSE
Funky Duke Ltd. grants you a limited, personal, non-exclusive, non-transferable license to install and use the Software solely for your personal, non-commercial entertainment on a compatible device.

3. PERMITTED USES

• You may install the Software on a single device.

• You may make one backup copy of the Software for archival purposes.

• You may transfer the Software permanently to another person, provided you do not retain any copies and the recipient accepts this EULA.
  
  

4. RESTRICTIONS
You may not:

• Remove or obscure any copyright, trademark, or proprietary notices;
  
  

• Modify, reverse-engineer, decompile, or disassemble the Software;
  
  

• Copy, lease, rent, distribute, publicly perform, or create derivative works of the Software;
  
  

• Use the Software for commercial purposes;
  
  

• Transmit the Software over a network or to multiple devices.
  
  

5. TRIAL VERSIONS
If the Software is provided as a trial, you may use it only for the limited period or number of uses. The Software may contain mechanisms to prevent use beyond this limit.

6. USER-GENERATED CONTENT & EDITORS
If the Software includes an editor or user content feature, you may create custom content ("Variations") under these conditions:

• Variations must work only with a full licensed version;
  
  

• Must not modify executable files;
  
  

• Must not include illegal, defamatory, or third-party protected content;
  
  

• Must not be commercially exploited or sold.
  
  

7. TERMINATION
This EULA is effective until terminated. You may terminate it by deleting or destroying all copies. Funky Duke Ltd. may terminate this EULA immediately if you breach its terms. All clauses regarding limitations of liability and warranties will survive termination.

8. LIMITED WARRANTY
The Software is provided "as is." If distributed on physical media, we warrant that the media will be free from material defects for 30 days. Your exclusive remedy is replacement of the defective media. This warranty is void if the defect results from misuse or damage.

9. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Software will be error-free or uninterrupted.

10. LIMITATION OF LIABILITY
In no event shall Funky Duke Ltd. or its affiliates be liable for indirect, incidental, special, or consequential damages, including but not limited to loss of data, revenue, or business. Liability shall not exceed the amount you paid for the Software.

11. GOVERNING LAW AND JURISDICTION
This EULA is governed by the laws of the State of Israel. All disputes shall be subject to the exclusive jurisdiction of the courts of Tel Aviv, Israel.

12. MISCELLANEOUS
If any part of this EULA is found to be invalid or unenforceable, the rest remains in effect. This EULA constitutes the entire agreement between you and Funky Duke Ltd. regarding the Software and supersedes all prior agreements.
